The products offered by Untraceabler (the "Company"), including but not limited to the Bash and Batch files, Android app (APK, AAB, and Android source code in a TAR.GZ file), and Progressive Web App (with source code available in both ZIP and TAR.GZ files) (collectively referred to as "the Software"), are provided "as is" without any warranties of any kind. By purchasing, downloading, or using the Software, you (the "User") acknowledge and agree to this Disclaimer in full. The User understands and agrees that the Company, including its owner, Joseph D. Smith, and all associated or affiliated parties, are not liable for any outcomes resulting from the use of the Software.

2. No Warranty  

The Company makes no representations or warranties of any kind, either express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Software is intended for informational and educational purposes only. The Company does not guarantee that the Software will be error-free, will meet the User's specific requirements, or will function without interruption.

3. Limitation of Liability  

In no event shall the Company, Joseph D. Smith, or any associated or affiliated parties be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the use or inability to use the Software. This limitation of liability applies to any claims based on warranty, contract, tort, or any other legal theory, even if the Company has been advised of the possibility of such damages.

4. User Responsibility  

By using the Software, the User acknowledges and agrees that they are solely responsible for complying with all applicable local, state, national, and international laws and regulations. The User assumes full responsibility for any legal or ethical consequences of using the Software. The Company does not endorse or condone any illegal or unethical activities, and the User agrees not to use the Software for any unlawful purposes.

5. Indemnification  

The User agrees to indemnify, defend, and hold harmless the Company, Joseph D. Smith, and all associated or affiliated parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to the User's use of the Software or breach of this Disclaimer.

6. Jurisdiction and Governing Law  

This Disclaimer is governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law principles. The User agrees that any disputes arising out of or related to this Disclaimer or the Software shall be subject to the exclusive jurisdiction of the courts located in Glasgow, Kentucky. By using the Software, the User consents to the jurisdiction and venue of these courts and waives any objections to such jurisdiction and venue.

7. Provision for Legal Fees  

If any legal dispute or arbitration is resolved in favor of the Company, Joseph D. Smith, or any associated or affiliated parties, the User agrees to pay any reasonable fees or costs incurred by the Company, Joseph D. Smith, or any associated or affiliated parties in connection with the legal action, including but not limited to court costs, attorneys' fees, and other related expenses.

8. Severability  

If any provision of this Disclaimer is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.

9. Changes to Disclaimer  

The Company reserves the right to update, modify, or replace this Disclaimer at any time without prior notice. It is the User's responsibility to review this Disclaimer periodically for changes. Continued use of the Software following the posting of any changes constitutes acceptance of those changes.

10. Acknowledgment  

By purchasing, downloading, or using the Software, the User acknowledges that they have read, understood, and agree to be bound by this Disclaimer.
